Welcome to Thoughtland Realty LLP ("1acre.in"), a digital marketplace for land and plot listings. By accessing or using our platform (including but not limited to website, mobile app, APIs, and related services), you agree to be bound by the following Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, please refrain from using our services.

1. Definitions:

1.1 "Platform" shall mean and include the website (www.1acre.in), mobile applications, APIs, and any other digital interface or technology, whether existing or developed in the future, that is owned, operated, or managed by 1acre.in for the purpose of facilitating land discovery and related services.

 

1.2 "User" means any natural or legal person who accesses, browses, registers on, or otherwise uses the Platform, whether for viewing listings, posting Content, availing services, or for any other permitted purpose, and includes both registered and unregistered Users and also includes brokers, real estate professionals, institutional investors, and individuals accessing the Platform in their personal or professional capacity.

 

1.3 "Listing Party" refers to any individual, landowner, broker, agent, developer, representative, or legal entity that submits, uploads, or otherwise makes available land or property listings on the Platform, either directly or through authorized representatives.

 

1.4 "Services" shall include all features, tools, functionalities, and offerings provided by 1acre.in through the Platform, including but not limited to listing facilitation, property search, map-based discovery, Tag-Along Services, data insights, and customer support.

 

1.5 "Content" includes, without limitation, all data, text, photographs, videos, graphics, maps, pricing details, contact information, branding elements, metadata, overlays, User submissions, and other materials published, displayed, transmitted, or stored on the Platform.

2. Platform Overview & Access

2.1 Introduction: 1acre.in is a digital marketplace designed to simplify land discovery and transactions across India. The Platform connects landowners, agents, and prospective buyers through curated listings of agricultural, residential, and commercial plots. With a focus on transparency and data, 1acre.in empowers users to make informed decisions. 1acre.in is a private platform and is not affiliated with, endorsed by, or a representative of any government authority or department.

 

2.2 Lawful Use: Users shall access and use the Platform strictly for lawful, authorized, and bona fide purposes in accordance with applicable laws. Any misuse, including but not limited to unauthorized access attempts, security breaches, misrepresentation of identity, dissemination of false information, automated data extraction, or transmission of unsolicited communications, is expressly prohibited and may result in legal consequences.

 

2.3 Access Termination: 1acre.in reserves the absolute right, at its sole discretion, to suspend, restrict, or permanently terminate any User's access to the Platform, without prior notice or liability, in the event of any violation of these Terms, misuse of the Platform, or conduct deemed unlawful, abusive, fraudulent, or detrimental to the Platform or its Users.

 

2.4 Grievance Redressal: For any concerns, complaints, or grievances relating to the Platform or its Content, Users may contact the Grievance Officer at [email protected] 1acre.in will use commercially reasonable efforts to address and resolve such grievances within fourteen (14) working days from the date of receipt.

 

2.5 Force Majeure:1acre.in shall not be liable for any delay or failure in performance due to events beyond its control, including natural disasters, server or connectivity failures, cyberattacks, legal or regulatory changes, or government actions. Such events may temporarily or permanently impact Platform operations. During such instances, 1acre.in will make reasonable efforts to restore the Services. However, Users agree that the Platform bears no responsibility for losses arising from such disruptions.

 

2.7 Amendments: 1acre.in reserves the right to amend, modify, or update these Terms, in whole or in part, at any time at its sole discretion, without prior notice. Any such revised Terms shall be effective upon being published on the Platform. Continued access or use of the Platform after such publication shall constitute deemed acceptance of the updated Terms by the User. Users are advised to review the Terms periodically for updates.

 

2.8 User Eligibility: Use of the Platform is restricted to individuals and entities legally competent to contract under Indian law. Users must be at least 18 years of age.

3. Data & Privacy

3.1 Data Collection & Consent: By accessing or using 1acre.in Users expressly consent to the collection, storage, and processing of personal and browsing data in accordance with the platform's Privacy Policy. Continued use constitutes deemed acceptance of such practices.

 

3.2 Cookies & Analytics: The Platform uses cookies and analytics tools to enhance functionality, monitor performance, and improve User experience. Users may adjust cookie preferences through their browser settings; however, disabling cookies may affect Platform functionality.

 

3.3 Scraping / Automation Ban: Any form of automated data extraction, including scraping, crawling, or mining of Platform Content, is strictly prohibited. Such actions constitute a breach of these Terms and may attract legal action, including injunctive relief and a claim for damages.

 

3.4 IP Ownership: All proprietary Content on 1acre.in, including but not limited to text, images, branding elements, layout, software, and overlays, is the exclusive intellectual property of 1acre.in and protected under applicable copyright, trademark, and design laws. Unauthorized use or reproduction is prohibited.

 

3.5 Third-Party Tools: 1acre.in may integrate third-party Services (e.g., Google Maps, analytics tools, payment gateways). Users acknowledge that such Services are governed by the respective third-party terms, and 1acre.in disclaims all liability arising from their use, including downtime, inaccuracy, or data processing by such Services.

 

3.6 Data Security: 1acre.in adopts reasonable technical and organizational measures to safeguard User data. However, the Platform shall not be held liable for any unauthorized access, cyber incidents, or data breaches that occur despite such precautions and are beyond its reasonable control.

4. Listings & Tags

4.1 Nature of Listings: All listings displayed on the Platform are submitted by Users, including landowners and agents. While 1acre.in may conduct basic screening for completeness and format, it does not verify legal title, encumbrances, or ownership. Users are solely responsible for conducting independent legal, technical, and site due diligence prior to any transaction.

 

4.2 Listing Categories:

4.2.1 Owner Listed: Directly by landowner or verified nominee.

4.2.2 Agent Listed: Posted by a broker/agent with claimed access

4.2.3 Facilitated: Properties listed by 1acre.in on behalf of owners.

These categories do not imply title verification or endorsement by 1acre.in.

 

4.3 Labels & Tags: Platform tags such as "Verified", "Premium", or similar labels are for informational and navigational convenience only. Such labels are based on internal criteria and shall not be construed as a certification of ownership, legality, or marketability of title by 1acre.in.

 

4.4 Honorary Titles: Designations such as " Top agent " or similar are honorary or functional titles conferred for Platform engagement and do not create any principal-agent relationship, legal authority, or contractual partnership with 1acre.in.

 

4.5 Verification Disclaimer: 1acre.in adopts a best-effort approach for review of listing Content but makes no warranties, express or implied, regarding the authenticity, accuracy, title status, or legal clearances of any property. All responsibility for verification rests solely with the prospective buyer or transacting party

 

4.6 Seller Accountability:The Listing Party shall be solely and exclusively liable for all information provided in the listing, including claims regarding ownership, measurements, and approvals. 1acre.in disclaims any liability arising from misrepresentations, false statements, or third-party disputes.

 

4.7 Takedown Policy: 1acre.in reserves the right to delist any property or listing upon receipt of a bona fide complaint supported by prima facie evidence of fraud, misrepresentation, or unauthorized publication. Takedown decisions are made at the sole discretion of the Platform and may not be contested.

 

4.8 Duplicate/Fake Listings: Listings identified as duplicate, false, misleading, or inconsistent with Platform policy may be removed by 1acre.in at its sole discretion without notice. Repeated or deliberate violations may lead to account suspension or permanent removal.

 

4.9 No Agency Representation:1acre.in acts solely as a digital intermediary and does not represent, negotiate for, or act as an agent or fiduciary for any party in property transactions, specifically concerning the listing of properties. No legal, contractual, or agency relationship arises between the Platform and any User or Listing Party, except where distinct facilitation, "tag-along," or "hand-holding" services are explicitly offered and agreed upon

 

4.10 RERA Disclaimer: 1acre.in is a technology-driven digital Platform that facilitates the listing and discovery of land parcels across India. The Platform does not engage in brokerage, real estate agency, or property development activities, and is not registered under the Real Estate (Regulation and Development) Act, 2016 (RERA).

5. Communication & Interaction

5.1 Buyer-Seller Contact: The Platform enables Users to initiate contact with Listing Parties via integrated communication tools. 1acre.in does not participate in, monitor, or assume responsibility for the Content, quality, accuracy, or outcome of such interactions. Users engage with each other at their sole risk and discretion.

 

5.2 User Conduct: All Users are expected to conduct themselves in a lawful, ethical, and professional manner while using the Platform. Any form of abusive language, threats, unlawful activity, discrimination, or unethical conduct—whether toward other Users or the Platform team—is strictly prohibited and may result in suspension or termination of access.

 

5.3 User Content:Users shall be solely liable for all Content submitted, uploaded, or published by them on the Platform, including but not limited to comments, reviews, messages, or feedback. 1acre.in reserves the right, but not the obligation, to review, moderate, or remove any Content that it deems offensive, false, unlawful, or in violation of these Terms. By uploading or posting any Content on the Platform, Users grant 1acre.in a worldwide, irrevocable, royalty-free license to use, reproduce, publish, adapt, or distribute such Content for any lawful purpose, including marketing and data analytics

 

5.4 Prohibited Conduct:The following actions constitute a material breach of these Terms and are expressly prohibited on the Platform:

5.4.1 Misrepresentation or identity fraud: Providing false, misleading, or inaccurate information regarding

one's identity, ownership of property, affiliation, or authority to list a property. This includes impersonating

another individual or entity, submitting forged documents, or creating accounts using false credentials.

5.4.2 Harassment or abuse: Engaging in any form of verbal, written, or behavioral harassment, abuse,

threats, defamation, intimidation, stalking, or offensive conduct toward other Users, 1acre.in

representatives, or third parties, through or in relation to the Platform.

5.4.3 False listings: Posting or attempting to post property listings that are inaccurate, misleading,

exaggerated, or fraudulent, including listings for properties not legally owned, authorized, or available for

sale. This includes manipulating location, price, status, size, or title details.

5.4.4 Spam or unsolicited advertising: Sending unsolicited messages, bulk emails, promotional Content,

affiliate links, or any form of advertisement through the Platform's messaging tools or User interfaces.

Users shall not use the Platform to promote external Services, solicit funds, or divert traffic.

5.4.5 Violation of any law or regulation: Using the Platform in any manner that violates applicable local,

state, national, or international laws, regulations, court orders, or third-party rights, including but not

limited to intellectual property laws, privacy regulations, real estate norms, or contractual obligations.

 

5.5 Electronic Communications:By using the platform, Users consent to receive communications from 1acre.in electronically, including via email, SMS, WhatsApp, or push notifications. These communications may be transactional, promotional, or service-related.

 

6. Paid Services & Subscriptions

6.1 Subscription Plans: 1acre.in may offer subscription-based plans (including "Premium" or other categories) with defined features and durations. All subscriptions are non-transferable, non-assignable, and intended solely for the subscribing user. Plan details and benefits are subject to change at the sole discretion of 1acre.in with or without notice.

 

6.2 Premium Subscription: The Premium Subscription is currently valid for a lifetime, subject to the company's continued operation. Benefits are defined by 1acre.in and may be modified or withdrawn at its discretion. To prevent misuse, access is limited to 30 property call listings per calendar month. Usage limits and access protocols may be revised as per policy.

 

6.3 Tag-Along Assistance:The Tag-Along service constitutes optional, curated coordination support offered by 1acre.in to assist users in exploring listed properties as part of the tag-along service. The Tag-Along service shall be subject to the terms and conditions set forth in the Tag-Along Engagement Letter.

 

6.4 Hand-Holding Support:1acre offers an optional, non-advisory facilitation service to assist Buyers in identifying, evaluating, and registering land parcels. Services include opportunity sourcing, coordination with sellers/agents, and documentation support from the date of engagement. Buyers transact directly with landowners and are solely responsible for legal, regulatory, and technical due diligence. All assistance is provided on a best-effort basis, and 1acre disclaims liability for title defects, legal disputes, or post-sale issues. The Hand-Holding Agreement governs commercial terms, including fees and refund eligibility.

 

6.5 Facilitated Services:Facilitated Services offered by 1acre.in exclusively for sellers for the purpose of identifying prospective buyers, generating leads, and assisting in the finalization of property transactions, including, but not limited to, basic coordination with third parties or general informational support, shall not constitute legal advice, brokerage, representation, or agency Services. 1acre.in assumes no liability or fiduciary duty in any resulting transaction. Refer to the "Facilitated Services Document" for specific terms.

 

6.6 Refund Policy:All payments made to 1acre.in for subscriptions, or any ancillary Services are final and non-refundable, except where expressly required by applicable law. Users are advised to review service features and limitations prior to making payments.

 

6.7 Restriction on Commercial Use:Use of the Platform, its listings, tools, data, or Services is strictly limited to personal, non-commercial purposes. Any unauthorized reproduction, resale, redistribution, or commercial exploitation of Platform Content or Services is expressly prohibited and may result in legal action and account termination.

 

6.8 Termination of Subscription:1acre.in reserves the right to suspend, revoke, or terminate any subscription or User access, with or without notice, in the event of breach of these Terms, misuse of the Platform, or conduct deemed abusive, fraudulent, or detrimental to Platform operations.

7. Developers Dashboard

7.1 Applicability & Subscription Limitation

a. This clause 7 shall apply exclusively to Users who have subscribed to the "Developers Dashboard"

offered by 1acre.in ("Developer Dashboard Users").

b. These terms shall not apply to general Users, individual buyers, or non-subscribed Users of the

Platform. Access to the Developers Dashboard is conditional upon an active, valid, paid subscription

and continued compliance with these Terms.

 

7.2 Professional Use

a. The Developers Dashboard is strictly for professional use by developers, builders, institutional investors,

funds, and corporate entities.

b. By subscribing, the Developer Dashboard User confirms that they are a sophisticated commercial user,

capable of independent evaluation, and not a consumer or retail buyer.

 

7.3 Access & license

a. Access is provided on a limited, non-exclusive, non-transferable license. The number of authorized

users shall be strictly limited to the number of valid licenses purchased by the User as part of the

applicable subscription plan. Each license shall permit access to one (1) designated user account only,

and each account shall remain permanently linked to the email address and/or mobile number provided

at registration, which cannot be changed or reassigned.

b. Credential sharing or external data dissemination constitutes a material breach and may result in

immediate termination without refund.

 

7.4 Confidentiality & IP

a. Curated Inventory Disclaimer: Any "curated" or "shortlisted" listings represent internal data organisation

only and do not constitute endorsement, verification, financial advice, or assurance of approvals,

feasibility, or returns.

b. Non-Circumvention: Where 1acre.in provides deal intelligence, introductions, or facilitation inputs in

respect of any opportunity accessed through the Developers Dashboard, the Developer Dashboard User

shall not directly or indirectly bypass or circumvent 1acre.in to transact with the seller or landowner for

the purpose of avoiding applicable facilitation or success fees. Any breach of this clause shall constitute

a material breach, entitling 1acre.in to recover the applicable fee, suspend or terminate access without

refund, and pursue available legal remedies.

c. No data, screenshots, reports, or extracts from the Developer Dashboard may be reproduced, shared,

published, or distributed outside the Developer Dashboard User's organisation without prior written

consent from 1acre.in.

 

7.5 Data, Mapping & Commentary

a. Commentary: All zoning insights, suitability notes, and development indicators are subjective opinions

and informational estimates only, and do not constitute legal, architectural, engineering, or planning

advice.

b. Mapping: Plot boundaries and overlays are approximate and illustrative, not survey-certified unless

expressly stated.

c. Regulatory Data: Zoning, CLU, FTL, and master plan data are derived from public sources and may be

outdated; official certificates and approvals must be independently obtained.

 

7.6 Facilitation Role

a. 1acre.in acts solely as a technology facilitator and discovery platform, and is not the seller, broker, or

principal unless expressly disclosed.

b. The seller may be an owner, aggregator, or agent, and the Developer Dashboard User must

independently verify authority and title.

c. 1acre.in may receive commercial consideration from one or both parties under separate arrangements.

d. Where a transaction involves any independent broker, agent, or intermediary, any brokerage,

commission, or other charges payable to such broker or agent shall be negotiated and settled directly

between the Developer Dashboard User and such broker or agent. 1acre.in shall have no role in, and

shall not be responsible or liable for, any acts, omissions, representations, disputes, or payment

obligations arising between agents and Developer Dashboard Users in connection with the Developer

Dashboard.

e. Nothing in this Clause or the Developers Dashboard shall be construed as creating any fiduciary,

advisory, partnership, joint venture, or agency relationship between 1acre.in and the Developer

Dashboard User.

 

7.7 Non-Reliance, Risk Allocation & Liability Disclaimer

The Developer Dashboard User expressly acknowledges and agrees that:

a. The Developers Dashboard is provided solely as a discovery and preliminary assessment tool, and does

not constitute a due diligence report, professional advice, or recommendation of any kind;

b. All acquisition, investment, and development decisions are made entirely at the Developer Dashboard

User's own risk, and the Developer Dashboard User shall independently conduct all legal, technical,

financial, regulatory, and site due diligence;

c. Any reliance placed by the Developer Dashboard User on the Developers Dashboard, its outputs, data,

analytics, or visual layers is entirely at the Developer Dashboard User's sole discretion and risk, and, to

the maximum extent permitted by applicable law, 1acre.in shall not be liable for any indirect, incidental,

special, or consequential losses or damages, including but not limited to loss of profits, project delays,

construction stoppages, approval failures, financing issues, or cost escalations arising from or in

connection with reliance on the Developers Dashboard or its data; and

d. For the avoidance of doubt, this exclusion applies even where such losses arise from errors, omissions,

or inaccuracies in zoning layers, buffer zones, or map overlays.

 

7.8 Fees, Charges & Renewal

a. All subscription fees for the Developers Dashboard are final and non-refundable, except where expressly

required by applicable law.

b. Subscription pricing, features, and inclusions may be revised at the time of renewal at 1acre.in's

discretion. Continued use upon renewal constitutes acceptance of revised terms.

c. For the avoidance of doubt, subscription fees for access to the Developers Dashboard do not include,

and are separate from, any facilitation charges, success fees, or transaction-based consideration

payable to 1acre.in where it acts as a facilitator, which shall be governed by a separate or transaction-

specific agreement.

d. Each land or opportunity listed on the Platform may carry separate brokerage or transaction-related

charges applicable to that specific property. The applicable percentage or fee structure shall depend on

the particular property and shall be discussed and agreed directly between the Developer Dashboard

User and the seller at the initiation of any transaction.

 

7.9 Audit

1acre.in reserves the right to monitor usage of the Developers Dashboard and suspend or terminate access in the event of suspected misuse, abnormal access patterns, or breach of these Terms.

 

7.10 Third-Party APIs & External Data

a. Certain features of the Developers Dashboard, including the "Evaluate Any Land" feature, rely on third-

party APIs, datasets, and external service providers. Such data and outputs are provided on an "AS IS"

and "AS AVAILABLE" basis.

b. 1acre.in does not control, verify, or guarantee the accuracy, availability, continuity, or completeness of

such third-party data and shall not be liable for any interruption, inaccuracy, modification, or

discontinuation of such services or for any loss arising from reliance thereon.

 

7.11 Survival

This Clause shall survive termination or expiry of the Developer Dashboard User's subscription. It shall prevail over any conflicting provisions of these Terms solely in relation to Developer Dashboard Users and the Developers Dashboard.

8. GIS & Mapping Tools

8.1 Data Sources: GIS and mapping data displayed on the Platform are derived from publicly available sources, including, but not limited to, Revenue Departments and municipal authorities, media publications, etc. Such data is compiled on a best-effort basis and is intended solely for general informational purposes.

 

8.2 Accuracy & Limitation: All map visuals, boundaries, and overlays presented on the Platform are approximate representations and are not certified for legal, cadastral, or transactional purposes. Users are solely responsible for cross-verifying all land details with the competent authorities.

 

8.3 No Guarantee:GIS overlays, plot markings, and spatial visuals do not constitute legal documentation, title verification, or proof of ownership. Users must obtain official land survey records or government certification before acting on any map-based information.

 

8.4 Liability Waiver:1acre.in expressly disclaims any and all liability, whether direct, indirect, or consequential, arising out of the use or reliance upon GIS, map overlays, or related data. The Platform assumes no responsibility for inaccuracies, omissions, or outdated spatial information.

9. Liability & Legal Safeguards

9.1 Platform Use Risk: The use of the Platform and its Services is entirely at the User's sole risk. 1acre.in makes no express or implied warranties, including but not limited to title accuracy, merchantability, fitness for a particular purpose, uninterrupted availability, or freedom from technical errors or defects.

 

9.2 Indemnity Clause: Users agree to fully indemnify, defend, and hold harmless 1acre.in, its affiliates, officers, employees, and agents against all losses, claims, liabilities, penalties, costs, or proceedings arising out of: (a) inaccurate, false, or misleading listings; (b) any illegal, unauthorized, or unethical use of the Platform; or (c) breach of these Terms or violation of applicable law.

 

9.3 Limitation of Liability:To the maximum extent permitted by law, 1acre.in's total cumulative liability for any claim arising out of or relating to the use of the Platform shall be strictly limited to the total subscription or service fees, if any, actually paid by the User to 1acre.in in the six (6) months preceding the claim.

 

9.4 Legal Notices:All notices, claims, or communications with legal effect must be sent by the User to [email protected] or through registered post to the address provided on the Platform. Such communications shall be deemed received only upon confirmed delivery.

 

9.6 Waiver:No failure or delay by 1acre.in in exercising any right, remedy, or provision under these Terms shall be deemed a waiver of such right or provision. A waiver, if any, shall only be effective if expressly provided in writing.

 

9.7 Survival:Notwithstanding termination or suspension of access, all clauses relating to intellectual property, disclaimers, indemnities, limitations of liability, dispute resolution, and governing law shall survive and remain enforceable in perpetuity.

 

9.8 Governing Law & Dispute Resolution:These Terms shall be governed by the laws of India. Any disputes, controversies, or claims arising shall first be attempted to be resolved amicably through mutual discussion. Failing such resolution, they shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996, with the seat and venue of arbitration at Hyderabad, Telangana, and proceedings conducted in English.
